Hong Kong tycoon Jimmy Lai sentenced to 20 years in prison following national security conviction
Court has sentenced Jimmy Lai to 20 years for foreign collusion and sedition in Hong Kong’s most high-profile case.
On Monday, Hong Kong media tycoon Jimmy Lai received a 20-year prison sentence following his conviction on national security charges, marking the conclusion of the city’s most prominent national security trial.
Lai was convicted on two charges of conspiracy to collaborate with foreign entities and one charge of disseminating seditious content. The case has extended over almost five years and represents the most important prosecution under the national security law enacted by Beijing.
The founder of the defunct Apple Daily newspaper was initially arrested in August 2020 and was convicted the following year. His 20-year sentence falls within the most severe penalty range of 10 years to life imprisonment for offenses considered to be of a serious nature and represents the harshest punishment imposed to date under the law.
The three national security judges stated that Lai’s sentence was heightened due to his role as the “mastermind” and driving force behind what they characterized as “persistent” conspiracies to collude with foreign entities.
The prosecution presented evidence suggesting that the conspiracies aimed to secure sanctions, blockades, and other aggressive measures from the US and various nations, involving a network of Apple Daily personnel, activists, and foreign individuals.
“In this case, it is clear that Lai was the mastermind behind all three charged conspiracies, and as such, he deserves a more severe sentence,” the judges stated.
“Concerning the others, it is challenging to differentiate their respective levels of culpability.”
Alongside Lai, six ex-senior staff members of Apple Daily, an activist, and a paralegal received prison sentences varying from 6 to 10 years.
The 78-year-old, a British citizen, has refuted all allegations, asserting in court that he is a “political prisoner” enduring persecution from Beijing.
His case has attracted significant international condemnation, including remarks from US President Donald Trump and British Prime Minister Keir Starmer, and has underscored the extended national security measures in Hong Kong following the pro-democracy protests of 2019.
The concerns are partially connected to Lai’s international reputation as a prominent critic of China’s Communist Party leadership and his political ties, especially with US Republicans. During the trial, prosecutors made reference to those connections.
In July 2019, at the peak of the protests, Lai had meetings with then US Vice President Mike Pence and then Secretary of State Mike Pompeo in Washington.
“The rule of law has been utterly dismantled in Hong Kong,” stated Jodie Ginsberg, CEO of the Committee to Protect Journalists. “Today’s shocking decision marks the end of freedom of the press in Hong Kong.”
“The global community needs to intensify its efforts to secure Jimmy Lai’s release if we wish to uphold press freedom universally.”
Lai entered the courtroom dressed in a white jacket, clasping his hands in a prayer-like gesture while smiling and waving to his supporters.
Advocates for human rights and supporters have intensified their demands for his release, expressing worries about his health condition.
“The severe 20 year sentence imposed on 78 year old Jimmy Lai amounts to a death sentence,” stated Elaine Pearson, Asia director of Human Rights Watch. “A sentence of this magnitude is both harsh and deeply unfair.”
Authorities in Beijing and Hong Kong have asserted that Lai was given a fair trial and emphasize that the national security law has been crucial in reinstating order in the city.
A multitude of Lai’s supporters lined up for days to secure entry to the courtroom, while extensive security measures were implemented in the vicinity, featuring police officers, sniffer dogs, and armored vehicles.
“I believe that Mr. Lai embodies the conscience of Hong Kong,” stated Sum, 64, who waited in line to attend the hearing.
“He advocates for the people of Hong Kong and addresses numerous injustices in mainland China, as well as promoting the advancement of democracy.” I believe that enjoying a few days of my own freedom while sleeping out here is preferable to witnessing him confined indoors.
During a meeting with Chinese President Xi Jinping in Beijing last month, Starmer brought up Lai’s case, as reported by individuals informed about the discussions. During a meeting in October, Trump also brought up the case with Xi.
Numerous Western diplomats indicated that discussions regarding Lai’s release are expected to escalate after the sentencing.
Robert Pang, Lai’s lawyer, stated that he could not provide any comments on the possibility of an appeal, mentioning that Lai has a period of 28 days to make that decision.
Judges indicated that they were not inclined to lessen Lai’s sentence based on his age, medical condition, or the duration of his solitary confinement, while recognizing that he would endure a “more burdensome” imprisonment compared to other inmates. The sedition sentence was reduced by one month, and one year was removed from each collusion charge.
