
Stephen Miller, a Trump adviser, claims the White House is considering suspending undocumented immigrants’ due process
Stephen Miller, a top Trump adviser, made news on Friday when he made the contentious claim that the Trump administration is investigating ways to deny undocumented immigrants their fundamental legal rights.
Miller stated outside the White House that the administration may attempt to halt “due process,” which would allow individuals to be arrested or deported without following the proper legal procedures or receiving a fair trial. Regardless of citizenship, this protection is a fundamental right for all Americans.
According to Miller, the Constitution has a clause that gives the government the authority to act in this way in the event of an invasion. He asserted that they are contemplating this dramatic measure since the quantity of immigrants entering the nation is comparable to a “invasion.”
Trump also expressed his frustration with the length of time it takes to deport people due to legal regulations and court processes in an interview last week. He told NBC’s Kristen Welker, “I was elected to get them the hell out of here.”
Trump shrugged and responded, “I don’t know,” when asked if he should abide by the Constitution.
The catch is that the Supreme Court just decided that immigrants still need to be given the opportunity to present their case in court. Several state judges have also ruled that it is illegal to refer to immigration as a “invasion.”
Legal professionals caution that it is risky to halt due process. Only four times in American history has it occurred, including during the Civil War and immediately following Pearl Harbor. It was considered excessive even at that time.
