OpenAI is requesting the dismissal of the lawsuit filed by Apple regarding trade secrets
OpenAI requested a U.S. judge on Wednesday to dismiss a lawsuit from Apple (AAPL.O), which accused the ChatGPT creator and two former Apple employees of stealing trade secrets to aid in its expansion into consumer hardware, asserting that it was developing something “entirely new.
“OpenAI does not have any use, need, or desire for Apple’s trade secrets. OpenAI is creating something completely unique and distinct from anything at Apple,” attorneys for OpenAI stated in the motion to dismiss submitted on Wednesday.
Apple did not respond right away to a request for comment from Reuters regarding OpenAI’s motion.
Apple claimed in its July complaint that OpenAI systematically acquired and utilized Apple’s confidential information through former employees, recruitment strategies, and supplier relationships to further its consumer hardware goals.
The lawsuit between the two tech companies has initiated a conflict regarding the control of future AI devices that may operate independently of traditional apps or operating systems. If these devices succeed, they could shift consumer focus away from Apple’s top-selling iPhone. Analysts speculate that OpenAI is developing its own phone or device. In the filing, OpenAI stated, “Apple’s complaint fails to sufficiently describe the information for which it claims trade secret protection; its generalized product development categories are not sufficient to survive a motion to dismiss.
The company contended that the iPhone manufacturer did not adequately prove it possessed “a protectable trade secret” or “plausibly allege misappropriation” by any of the defendants. “The motion stated that Apple should not be allowed to utilize a groundless and pretextual lawsuit to compensate for its deficiencies in the talent market, its challenges in retaining employees, and its shortcomings in integrating AI into its products.
The two companies maintain a partnership that enables Apple users to access ChatGPT results via Siri, and iPhone users can sign up for ChatGPT memberships directly from the iOS settings menu.
