Jay-Z’s attorneys assert that the rape accuser’s window for filing a lawsuit “expired” years ago and hope to have it dismissed
In an effort to have the rape allegation against him dismissed, Jay-Z and his legal team are attempting every possible strategy.
Deadline reported that on Monday, December 30, Alex Spiro, the attorney for the chairman of Roc Nation, submitted new documents related to the continuing rape case. His legal team is attempting to contest the complaint alleging that Jay-Z committed rape, arguing that the claimed assault occurred months prior to the implementation of a statute in December 2000 that provided victims of gender-motivated violence with civil recourse.
The rapper’s attempts to have allegations that he and Sean “Diddy” Combs sexually abused a 13-year-old dismissed and the Jane Doe plaintiff unmasked were denied by a federal judge in New York a few days prior. Jay-Z and his legal team are attempting to utilize the calendar and geography to assist them get the lawsuit dismissed out after their previous attempts to do so failed.
In a letter to Judge Analisa Torres on Monday, Spiro stated, “As a matter of law, the plaintiff cannot recover for her sole claim under the Victims of Gender-Motivated Violence Protection Act (the GMV Law), because the statute does not have retroactive effect,” according to Deadline. The plaintiff claims that behavior that allegedly took place in September 2000 violated the GMV Law. However, the GMV Law cannot be applied retroactively to establish a cause of action that was not available to the plaintiff at the time in question because it was not passed until December 19, 2000, three months after the FAC says the conduct happened.
Insisting that Jane Doe’s right to file a lawsuit “expired no later than August 2021,” Spiro and Jay-Z are intensifying their dispute over the timetable.
According to Jay-Z’s legal team, “any viable GMV Law claim is time-barred under New York’s Child Victims Act (CVA), which preempts Plaintiff’s GMV Law claim.” They cite a now-dismissed sexual assault complaint from a minor that Aerosmith singer Steven Tyler was faced with in late 2023. “The Courts in this District, however, have recognized that the CVA’s revival period preempts the GMV Law’s overlapping and extended one,” the statement reads, referring to the fact that the CVA was actually revised in 2019 with an additional 30 months.
Jane Doe filed the aforementioned lawsuit earlier this month, alleging that at the age of 13, she was raped by Diddy and Jay-Z during an MTV Video Music Awards afterparty in 2000. The accusations have been refuted by both rappers.
After Jay-Z’s attorney attempted to have the case dismissed and Doe’s identity made public, Judge Torres decided last week that Jane Doe could stay anonymous in court documents that TMZ was able to obtain. The judge did, however, point out that things might change as the case develops and that he plans to review the matter if and when it does.
Jay-Z’s legal team is making every effort to prevent it from occurring.
