A Brazilian judge rules that Adele’s song must be taken off globally due to a plagiarism allegation
A Brazilian court has ordered the worldwide removal of Adele’s song Million Years Ago from streaming services and other outlets due to claims of plagiarism made by Toninho Geraes, a Brazilian composer.
Sony Music and Universal Music face fines of $8,000 per infraction if they do not comply with the injunction, which was imposed by Judge Victor Torres of Rio de Janeiro’s 6th Commercial Court.
Martinho da Vila’s 1995 samba hit, Mulheres (Women), is allegedly plagiarized in the 2015 song, according to Geraes. In addition to composition credit, he is requesting royalties and $160,000 in damages.
According to Geraes’ attorney, Fredimio Trotta, “this is a milestone for Brazilian music, often used without proper credit.” He also stated that streaming services and international broadcasters will be informed.
Brazil’s adherence to the Berne Convention’s international copyright provisions is demonstrated by this case. Although Sony and Universal may file an appeal, the injunction serves as a message to international musicians about the exploitation of Brazilian music.
Million Years Ago, was accused of plagiarism in 2015 due to its similarity to a song by Ahmet Kaya, a Kurdish singer.
