Diddy Wins Big In Court When Judge Throws Out Sexual Battery Case Due To Statute Of Limitations
Sean “Diddy” Combs has achieved another victory amid the various legal challenges that have surrounded him lately.
John Doe has accused the founder of Bad Boy Records of drugging and sexually assaulting him in a nightclub.
A judge has dismissed the case against Sean “Diddy” Combs, determining that the statute of limitations for the claims has expired.
The lawsuit for sexual battery against Diddy has been dismissed.
A judge has dismissed a sexual battery lawsuit against Diddy, reducing his list of legal troubles by one.
A civil lawsuit was filed by an anonymous plaintiff in February, claiming that Diddy drugged and sexually assaulted him at a nightclub during the same month.
The accuser asserted that he was a 23-year-old emerging artist who had landed a performance at the club where Diddy was present.
The lawsuit, initiated by attorney Tony Buzbee, alleged that John Doe was provided a drink and subsequently lost consciousness, only to awaken to Diddy engaging in “unwanted sexual contact” with him, while also threatening his career should he resist.
A New York judge has dismissed the case, determining that the time permitted for the plaintiff to file has elapsed.
TMZ reports that the judge highlighted a 5-year statute of limitations from the time of the alleged assault, clarifying that a new law enacted in 2019, which extends the statute to 20 years, is not retroactive and thus does not pertain to this case.
The rapper achieved a legal victory over Sara Rivers.
The dismissal comes after a distinct legal triumph for Diddy in August, when a federal judge dismissed multiple claims in a $60 million lawsuit brought by former “Making the Band 2” singer Sara Rivers.
The Blast reported that Rivers filed a lawsuit in February, claiming that the “Finna Get Loose” rapper subjected her to hostile and inhumane treatment during the reality TV show.
The lawsuit, brought forth by attorney Ariel Mitchell, referenced the notorious “cheesecake” incident from the show as a representation of Diddy’s repeated acts of abuse, as she and the other members of the group reportedly had to trek several blocks to satisfy his desires.
Rivers alleged that Diddy sexually harassed her by cornering her and touching her breasts, along with accusations that he acted with malice and recklessness regarding her career when he disbanded the group while retaining her show earnings.
A judge dismissed 21 claims presented in Sara Rivers’ lawsuit.
Reports indicate that a judge dismissed the majority of Rivers’ claims in her lawsuit with prejudice, signifying that they cannot be refiled.
A total of 21 claims were dismissed, including racketeering, assault and battery, forced labor, sexual harassment, and false imprisonment.
An unresolved claim remains, as the judge stated that the “determination of whether to dismiss, with or without prejudice, Count 15 (the Gender-Motivated Violence Protection Act claim) … is hereby stayed pending” a ruling from an appellate court.
Diddy’s Sentencing Approaches
In spite of the recent dismissals, Diddy continues to confront multiple other civil lawsuits containing similar allegations.
The rapper known for “Bad Boy For Life” continues to be incarcerated at the infamous Brooklyn Metropolitan Detention Center as he awaits his sentencing in October.
After a 6-week trial concerning allegations of sex trafficking, racketeering, and transportation for the purpose of engaging in prostitution, Diddy was acquitted of the more serious charges but was convicted on two counts related to prostitution.
He could face a maximum of 10 years in prison for each count, though reports indicate that he is unlikely to receive the maximum sentence in this situation.
