
Court Shatters Diddy’s Aspirations For A Mistrial On Day 20
Diddy will need to decide on a different course of action in order to escape his continuing legal dispute.
The rapper’s plea for a mistrial in his continuing lawsuit, which has witnessed a growing number of contentious witness statements against the mogul, was denied by the judge overseeing the case.
On September 16, 2024, Diddy was taken into custody in New York. Following a federal indictment and raids on two of his residences in Miami and Los Angeles, the arrest was made.
According to new testimony, Diddy allegedly tried to throw his ex-friend from a balcony.
Judge Arun Subramanian, who presided over Diddy’s federal racketeering and sex trafficking trial, has turned down the motion for a mistrial. This ruling followed contentious testimony by Cassie’s friend Bryana Bongolan, and the trial entered its twentieth day.
In September 2016, Bongolan said, Diddy allegedly dangled her over the edge of a 17th-floor balcony at Cassie’s condominium in Los Angeles. Diddy’s defense team contended that Cassie’s earlier testimony, in which she claimed to have witnessed the incident, was false.
They said that Cassie’s claim was refuted by text messages she exchanged with Kristina Khorram, Diddy’s former head of staff. According to a message obtained by TMZ, Cassie implied that she had not witnessed the incident, writing, “I just found out some crazy sh-t.”
The plaintiff was accused by the rapper’s lawyer of presenting false evidence.
Diddy’s attorneys claimed that the prosecution had given misleading testimony as a result of this disparity and filed for a mistrial. Additionally, they contested the veracity of images allegedly depicting Bongolan’s injuries from the balcony incident.
The information from the photos showed that Diddy was on the East Coast, far from the purported scenario in California, according to his attorneys.
Diddy’s plea for a mistrial has not yet been answered by prosecutors, although they did explain in court that Cassie’s texts appeared to indicate the incident happened later, on or around September 29 or 30, 2016.
Judge Subramanian acknowledged Bongolan’s history of substance misuse during the proceedings, saying, “Thank God she’s sober,” but decided not to consider her evidence to be perjury.

Judge Subramanian summoned the mogul to order during his federal trial on Thursday, according to information released by The Blast last week. According to reports, the judge’s remarks were prompted by the court officer drawing his attention to Diddy’s actions.
The judge then went on to denounce Diddy for acting in an inappropriate manner and threatened to have him evicted from the property if the behavior persisted.
Additionally, Subramanian blasted the rapper’s defense team for his improper dealings with jurors. Noting that Diddy had been nodding enthusiastically throughout interrogation, he underlined that no facial expressions should be aimed at the jury.
The judge declared that this conduct was “unacceptable” and threatened to “give an instruction to the jury” or perhaps bar Diddy from the courtroom if he tried to interact with the jury any more.
Diddy’s lawyer responded by promising the judge that these kinds of exchanges would never happen again.
The head of the record label was accused of attempting to win sympathy by using his children.
The fact that Diddy’s children, including his 18-year-old twin daughters, attended his trial has drawn criticism. In a May 2025 interview, Aubrey O’Day, one of Diddy’s accusers and the former lead singer of his girl group, Danity Kane, voiced her reservations about this move.
Why would any father want his kids to see the explicit testimony that described the unsettling aspects of his alleged behavior, she asked?
“I don’t know any father that would want their children to sit through testimony about how much their daddy liked to watch people [get] lubricated, f-cking, getting pissed on and urinated in their mouths, having his girlfriend come in the other room and rub their c-m all over his nipples,” said the performer.
O’Day added that the kids’ appearance in court might potentially be a calculated attempt to win the jurors over. “His children’s presence at the trial creates a strong visual impression meant to benefit the defense,” she said.
