
Diddy’s defense argues that he has mental impairment, but the prosecution disputes this
According to sources, Sean “Diddy” Combs is putting together an unconventional defense as the trial date of May 5 draws near.
According to reports, Diddy’s defense team intends to contend that because he was intoxicated, he lacked the mental capacity to carry out the alleged crimes.
But as the trial date draws closer, prosecutors are adamantly against this tactic.
Diddy want to have a physician testify.
A Columbia professor’s testimony is at the heart of Diddy’s defense, according to papers TMZ was able to secure.
Diddy, according to the prosecution, wants the physician to attest to the fact that he suffered from a “mental condition bearing on the issue of guilt.” The court records don’t go into detail about the purported ailment. But there are clues about Diddy’s alleged drug and alcohol abuse.
The prosecution claims that “legal precedent requires the defense to give proper notice before offering any evidence of the effects of drugs and alcohol on a defendant’s memory or cognitive function.”
The doctor’s testimony, they add, aims to demonstrate Diddy’s “inability to control [his] behavior.”
But the indictment itself complicates this argument. Diddy is charged at the federal level with drugging his victims during the alleged “freak offs.” Diddy’s team is now speculating that he may have been under the influence of drugs.
Prosecutors argue that the testimony of doctors is irrelevant.
Prosecutors maintain, however, that the doctor’s assessment is irrelevant. They note that Diddy was never directly evaluated by the doctor.
Rather, the specialist would depend on his whole experience with people. Prosecutors claim in their filing that it doesn’t matter if the doctor believes Diddy was “lucid” at the time.
Prosecutors also wish to exclude a forensic video specialist, another defense witness, who would examine the tape of the Cassandra “Cassie” Ventura hotel beating.
Although the judge has not yet made a ruling on either request, important decisions will soon be made because the trial is only one week away.
Diddy’s attorneys use his lifestyle as justification.
These disclosures come after Diddy’s lawyers reportedly gave a sneak peek of his defense during last Friday’s court session in New York.
They maintained that Diddy led a “swinger” lifestyle and that, despite his unusual actions, they were not illegal.
Marc Agnifilo, Diddy’s lawyer, told the court at the Manhattan courthouse, according to the BBC, “There’s a lifestyle, call it swingers or whatever you will, that he thought was appropriate because it was common.”
As he went on, “Many people think it’s appropriate because it’s common.”
Arun Subramanian, the current judge, decided that Diddy’s defense team could bring up his own lifestyle choices throughout the trial. They are not permitted to bring up other well-known swingers or those who are alleged to have employed sex workers, though.
Diddy Turns Down a Plea Offer
Federal prosecutors also disclosed during the court that Diddy had been presented with a plea bargain, which he had turned down. They kept the specifics of the agreement private, though.
Throughout the hearing, the 55-year-old musician seemed solemn, passing notes to his attorneys and whispering to them in hushed tones.
One of his sons was in the courtroom, and he once smiled at him.
Diddy is charged with sex trafficking, racketeering conspiracy, and transportation to engage in prostitution. He might be sentenced to life in jail if found guilty.
