President Yoon Suk Yeol’s arrest following impeachment is approved by a South Korean court
The political crisis in South Korea is further exacerbated by the approval of the detention of impeached President Yoon Suk Yeol in response to the martial law declaration.
On Tuesday, a South Korean court issued an arrest warrant for President Yoon Suk Yeol in response to his impeachment and suspension from office. This decision was both unprecedented and historic. The decision was made in response to Yoon’s imposition of martial law in early December, which has precipitated a political crisis in the nation.
The arrest warrant was granted by the Seoul Western District Court as part of an investigation into Yoon’s brief but controversial declaration of martial law, according to the Corruption Investigation Office for High-ranking Officials (CIO). According to investigators, Yoon is accused of leading an insurrection, a severe criminal offense for which a reigning South Korean president is not entitled to immunity.
The arrest warrant remains valid until January 6, while Yoon’s trial on impeachment allegations is currently underway at the Constitutional Court. Yoon is anticipated to be detained at the Seoul Detention Center if executed, as reported by the Yonhap news agency.
The situation has resulted in a deteriorating political crisis in South Korea, which is the fourth-largest economy in Asia and a significant U.S. ally. Immediately following Yoon’s impeachment, Prime Minister Han Duck-soo momentarily assumed the role of acting president. However, he was also impeached by the opposition-controlled parliament. The aftermath of the Jeju Air Flight 7C2216 accident, South Korea’s deadliest air disaster, is currently being addressed by Finance Minister Choi Sang-mok, who is currently serving as acting president. The crash resulted in the deaths of 179 individuals.
In the interim, Yoon’s legal team has contested the validity of the arrest warrant. Yoon Kab-keun, his attorney, contended that the CIO is not authorized to request such a warrant under South Korean law. The president’s legal team intends to submit an injunction to the Constitutional Court in order to prevent its enforcement.
South Korea’s inaugural martial law declaration since the 1980s was issued by Yoon on December 3, with the objective of prohibiting political activities and media censorship. The National Assembly in Seoul was entered by troops that evening; however, they were repelled by aides who were armed with fire extinguishers. The martial law was promptly denied by lawmakers, and Yoon rescinded the order hours later in response to public outrage.
The consequences were severe and immediate. Yoon narrowly escaped an initial impeachment attempt; however, opposition lawmakers subsequently joined his party members to impeach him on December 14. The Constitutional Court is scheduled to hear the next arguments in Yoon’s impeachment trial on Friday.
The arrest warrant was approved by the district court, which cited extensive evidence supporting the allegations against Yoon and a substantial likelihood that he would fail to respond to summonses. The presidential security service has obstructed attempts to investigate the presidential office, but the court has also authorized a search of Yoon’s residence.
Ever since martial law was declared, Yoon has consistently disregarded the summonses of investigators, which has served to escalate tensions. Kim Yong-hyun, his former defense minister, has been detained and charged with insurrection and abuse of power, despite his significant involvement in the decree.
The arrest warrant has elicited a variety of responses. The action was criticized as “inappropriate” by Kweon Seong-dong, the acting leader of the ruling People Power Party, while opposition Democratic Party lawmaker Kim Yong-min called for its immediate enforcement.
