Musk’s lawyer defends the $1 million reward and denies claims that it is an illegal lottery

A Pennsylvania court is looking closely at Musk’s $1M giveaway because it is meant for spokespeople and not random winners.

A lawyer for Musk said on Monday that the people who get the $1 million a day that his pro-Trump group gives to registered voters are not chosen at random, but rather people who would be good spokespersons for its goals.

Chris Gober, who is defending Musk, told a judge in Pennsylvania that the giveaway was not a “illegal lottery” as Philadelphia District Attorney Lawrence Krasner said it was. Krasner has sued to stop the contest before Tuesday’s US presidential election.

During the hearing in front of Judge Angelo Foglietta, Gober said, “There is no prize to be won; instead, recipients must fulfill their contractual obligations to speak for the PAC.”

The meeting in this important swing state takes place just one day before the very close election between Democratic Vice President Kamala Harris and Republican former President Donald Trump. Musk backs Trump, and so does his political action group (PAC).

Only people who are registered to vote in Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania, and Wisconsin—the seven states that are most likely to decide the election—can enter the Tesla CEO’s offer. America PAC said that its last two winners would be from Arizona and Michigan. This suggests that Musk could keep giving away prizes even if Foglietta tells the raffle to stop.

In his statement, Krasner did say, though, that he would try to get Musk and America PAC to pay fines. He made it clear that he would not try to get back the money that had already been given to the contest’s 16 winners.

Since October 19, Musk has been giving a $1 million check every day to a voter chosen at random from the people who signed his petition in support of gun rights and free speech. In the past year, Musk has become a vocal supporter of Trump. He has been supporting the former president on his X social media platform.

Krasner, a Democrat, sued Musk and his PAC in state court on October 28. He said they were running an illegal lottery that broke state consumer protection rules.

John Summers, a lawyer in Krasner’s office, said that Gober’s words were a “complete admission of liability.”

Summers said, “We just heard this guy say that my boss and client called this random.”

We told people they would be part of a random process, but we chose the people who would be part of it ahead of time.

Reports say that Summers then showed the court a video clip of Musk at a Trump gathering on October 19 in which Musk said that America PAC would “randomly” give $1 million to people who signed a petition every day until the election. Additionally, Musk said in the video that the winners would have to be spokespersons for the PAC.

Philadelphia is one of the seven battleground states that will decide the election between Trump and Harris. It is the biggest city in Pennsylvania. The candidate who wins in this state will get 19 of the 270 electoral votes needed to win the race.

There is some legal gray area surrounding the gift when it comes to election laws, and experts aren’t sure if Musk’s actions break federal laws that say you can’t pay people to register to vote.

Reports in the media say that the U.S. Department of Justice warned America PAC that the giveaway might be against the law, but federal officials have not said anything in public.

According to government records, Musk has given almost $120 million to America PAC so far.

The super PAC started by Elon Musk, the richest person in the world, is very important to what is expected to be a very close election because the Trump campaign depends on outside groups to reach out to voters.
