Kevin Hart recounts a 2017 incident in which he cheated on his pregnant wife, Eniko, using drugs in a new court filing

Hart stated in a deposition submitted to the Los Angeles Superior Court on August 6 that he slept with Montia Sabbag the morning following his MDMA use.

Kevin Hart claimed that he was on methamphetamine the night before he spied on his then-pregnant wife, Eniko Hart, in 2017.

In connection with Hart’s 2017 sex-tape controversy, PEOPLE has obtained a new court filing from his breach-of-settlement legal battle with erstwhile friend Jonathan “J.T.” Jackson. The filing includes a transcript of Hart’s September 2017 deposition, in which he recounts the events of that evening in his own words.

Hart, 45, claimed that he and an unidentified friend were “partying” when the friend offered him “molly,” a substance that he initially declined because “I don’t really f— with drugs like that,” according to the document, which was submitted in Los Angeles Superior Court on Aug. 6.

In the 30-plus-page deposition, the actor and comedian further stated that his companion exerted pressure on him to consume the substance and assured him that he would not “allow [Hart] to do anything.” This resulted in Hart saying “f— it” and incorporating it into his drink, which was “watered down.”

“I believed that I was at ease because it was present in my beverage.” Drinking is acceptable to me. Good night. I am currently with the lady [Montia Sabbag] at the end of the night as the night progresses, correct? “Hart said.”

He proceeded to recollect additional details of the evening, including additional time spent imbibing and socializing with Sabbag and another woman named Morgan. Subsequently, he declared that he felt “f—— up” and retired to bed fully clad. After that, he stated that Sabbag also entered the bed, but he was wearing a nightgown.

“I am rendered unconscious.” Absolutely nothing transpired that evening. The female and I did not engage in sexual intercourse that evening. I engaged in sexual intercourse with her the following morning. Borderlands actor asserted, “She roused me.”

Hart asserts in his filing that “[Montia] was faced one way while we were having intercourse… She collapses onto the bed in a reverse way. That was her endeavor to approach the camera.

She was repelled by my actions. Partially, he continued, “You never witness me engaging in sexual activity in that vicinity.”

The moment she stood up, she proceeded to sit on the bench, which is clearly visible in the camera’s view. She sat on the bench and initiated conversation with me… “She ensured that I performed the task in that location, so it was evident that I was in the room,” Hart claimed.

Hart issued an apology to his wife and children in a 2017 Instagram video following the emergence of extortion allegations regarding the sexually suggestive video. He stated, in part, that he “made a bad error in judgment and placed myself in a bad environment where only bad things could happen, and they did.”

According to court documents obtained by PEOPLE, Jackson filed a $12 million breach of written contract lawsuit in Los Angeles County Superior Court last month. In the lawsuit, he accused Hart of failing to adhere to the language they had agreed upon in a July 2021 settlement when he addressed the sex-tape scandal on Instagram in October of that year.

Jackson was accused of threatening to disclose a sexually explicit video of Hart with an individual who was not his wife in 2018, with the intention of extorting him. Jackson’s allegations were dismissed in September 2021.

According to the complaint, Hart intended to express that he had “lost someone close to me that I loved and still have very much love for or high levels of love for. I am proud to announce that all charges against JT Jackson have been dropped, and he is not guilty and had no involvement in the matter. This matter, which was previously so difficult to deal with and so heavy for me and my household, has now ended.”

Daniel L. Reback, Jackson’s attorney, stated to PEOPLE at the time, “We are certain that the lawsuit will conclude with Mr. Jackson’s complete victory and vindication.”
